Presentación
Los diez años de edición ininterrumpida que cumple YACHANA en el año 2022, no son sino el
reejo del compromiso de los académicos a su cargo, así como de la Universidad Laica VICENTE
ROCAFUERTE de Guayaquil, en el exitoso desarrollo de la presente revista académica de
acceso abierto. En ella destacan los altos estándares seguidos en su elaboración, la corrección
en la construcción de sus contenidos, la calidad de sus contribuciones cientícas, así como el
seguimiento de los estándares internacionales asociados a las publicaciones académicas, todo en
el convencimiento de la importancia de la difusión del conocimiento cientíco en la comunidad,
nacional e internacional, con la esperanza de que la circulación del mismo facilite la implementación
de cambios que permitan la construcción de mejores condiciones de vida para quienes habitamos el
espacio común que nos cobija.
Desde la perspectiva de un profesor de Derecho procesal, como lo es quien escribe estas breves
líneas, así como de la propia de un observador atento e imparcial, fácil es advertir que, en los
últimos decenios, numerosas reformas procesales, de naturaleza global, se han conducido en la
región latinoamericana. Uno de los tránsitos que normalmente se destaca como central en ellas es
el que va desde la escritura hacia la oralidad. Empero, hoy se avizora una nueva transformación,
desde el expediente físico o en formato papel al expediente digital o electrónico y, en general, a
una visión que considera la introducción de nuevas tecnologías en los procesos, todo lo cual se ha
visto fortalecido por la pandemia de COVID-19, más allá de la cual se abren espacios incluso para
espacios de automatización de la decisión judicial, propios de la inteligencia articial.
Tales transformaciones, en el seno del Poder Judicial y de la Administración de Justicia en general,
suponen nuevos desafíos, ya sea en el ámbito de la seguridad tecnológica; en el de la capacitación
de los operadores del sistema; o, entre otros aspectos, en el cumplimiento de estándares éticos, que
eliminen eventuales sesgos en la construcción de los algoritmos asociados a los nuevos derroteros.
Los cambios tecnológicos, así esbozados, corresponden a una tendencia que, progresivamente,
adquiere relevancia en la planicación de los sistemas de justicia, un ámbito tradicionalmente
distante de ellos.
Sin embargo, las nuevas tecnologías, así como las innovaciones a ellas asociadas, exceden,
naturalmente, los temas propios de la especialidad que profeso, e incluyen múltiples derroteros,
desde la transformación digital del Estado, asociada a los diversos procedimientos administrativas
que la integran, hasta, por ejemplo, la relevancia de la información digital en los tiempos actuales,
con las oportunidades y aprehensiones a su buen uso asociadas.
No es extraño, entonces, que la revista YACHANA se preocupe de tales materias, a cuyos efectos
el presente número de esta ha considerado la construcción de un dossier sobre el Derecho Digital y
vinculadas a ello las nuevas tecnologías y la innovación en el ámbito jurídico.
Así, en tal marco, se consideran en el presente ejemplar de la revista YACHANA cuatro trabajos,
cuidadosamente seleccionados, que buscan aportar, con sus reexiones, a dicho debate. Así
